Development Assessment and Control

The following functions are carried out within Planning and Development Services:

  • Assessment of Development Applications submitted to Council with regard to Council's plans, policies and the relevant provisions of the Environmental Planning & Assessment Act 1979 and the Building Code of Australia, taking into consideration the views of the community.

  • Assessment of Construction Certificate, Compliance Certificate, Complying Development Certificate and Occupation Certificate applications submitted to Council for the approval of building works and engineering works.

  • Issue of Section 149 (Planning) and Section 149 (Building) certificates pursuant to the Environmental Planning & Assessment Act 1979.

  • Assessment of applications for the authorisation of premises used for public entertainment.

  • Assessment of applications for the removal and lopping of trees.

  • Liaison with the community in respect of Development Applications.

  • Enforcement of the provisions of the Environmental Planning & Assessment Act 1979 and the Local Government Act 1993 in respect of the use of land and premises. This includes the defence of appeals against Council decisions lodged in the Land & Environment Court and the initiation of legal action in the local Court and Land and Environment Court regarding unauthorised and non-complying development.

  • Approval of applications to install Septic Tanks and Solid Fuel Heaters, pursuant to Section 68 of the Local Government Act 1993.

Yass Valley Council Section 94 Contributions Plan - Published: 14 Apr 2005
The provisions of Council's Section 94 Plan applies to development within urban and rural areas, and provides for the levying of contributions for public amenities and services including the following:
  • Urban Roads & Traffic;
  • Community facilities;
  • Open space improvements;
  • Bushfire facilities;
  • Plan administration.

Building Certificates - Published: 21 Sep 2004
The issuing of a Building Certificate prevents Council from requiring that the building be repaired, demolished, altered, added to or rebuilt in relation to any existing matters, or arising only from the deterioration of the building as a result of fair wear and tear; or from taking proceedings in relation any existing encroachment by the building onto land vested in or under the control of Council, for a period of 7 years from the date of issue. more ..

When can construction commence? - Published: 17 Sep 2004
Where development consent from Council to carry out a particular activity involves the erection of a building or the construction of roads, a Construction Certificate must also be obtained prior to the commencement of any building or construction works on site. more ..
